Vietnam-based representative office of a foreign trader (“RO“) is a dependent unit of foreign trader, which is established under the provisions of Vietnamese law to conduct market survey and carry out a number of commercial promotion activities permitted by Vietnamese law.
Before January 30, 2024, The RO is responsible for sending a report according to the form BC- 1 about its activities for the year 2023 by post to the Licensing Authority. When requested by a competent state agency, the RO is obliged to report, provide documents or explain issues related to its activities (Article 32 of Decree No. 07/2016/ND-CP and Circular No. 11/2016/TT-BCT).
Failure to make a report or dishonest report on the activities of the RO or failure to report, provide documents or explain issues related to the activities of the RO as requested by the competent state agency will be considered and punished for administrative violations in the form of fines ranging from 10.000.000 dong to 20.000.000 dong (Article 67 of Decree No. 98/2020/ND -CP).
