Foreigners entering Vietnam have to declare their temporary residence as prescribed in Article 33 of the Law on entry, exit, transit and residence of foreigners in Vietnam (Law No. 47/2014/QH13 as amended and supplemented by Law No. 51/2019/QH14), Article 2 and Article 3 of Circular No. 53/2016/TT-BCA.
Accordingly, if you are a foreigner temporarily residing in Vietnam , you must carry out procedures for temporary residence declaration. In case you temporarily resides in Vietnam has declared your temporary residence but changes your temporary residence or resides outside the address stated in your permanent residence card, you must declare your temporary residence according to the new temporary residence address.
The implementation of procedures for temporary residence declaration for foreigners is specified as follows:
– Persons making temporary residence declaration:
Foreigners do not make declaration of temporary residence by themselves, but must go through temporary resident declarants:
+ In case a foreigner stays at an accommodation, the representative of the accommodation (or an authorized person, the person assigned to directly manage and operate the accommodation) is responsible for making a temporary residence declaration for foreigners;
+ In case the accommodations are leased to foreigners for long-term stay but the owners of the accommodations do not reside there or the houses are purchased by foreigners, the person named in the rental contract or the house purchase contract is responsible for declaring temporary residence for foreigners temporarily residing at that accommodation.
– Time limit for temporary residence declaration:
The temporary resident declarant is responsible for declaring temporary residence to foreigners within 12 hours, for remote areas within 24 hours from the time the foreigner arrives at the place of temporary residence.
– How to declare temporary residence:
+ Tourist accommodation is a hotel that declares temporary residence for foreigners through the website of the Immigration Department of the provincial Public Security where the accommodation is located (hereinafter referred to as “Website”);
+ Other accommodations can choose one of two methods of declaring temporary residence for foreigners via the Website or using the Temporary Residence Declaration Form. It is recommended to do so via the Website.
For the method of declaring temporary residence via the Website, the temporary resident declarant needs to take two steps:
Step 1: Access the Website and provide information to receive a declaration account;
Step 2: Access the Website, log in to the declaration account to declare temporary residence information for foreigners as soon as foreigners come to register for temporary residence.
Note: The temporary resident declarant is responsible for the management and security of the declaration account and all information generated by the declaration account. When detecting that the declaration account has been stolen, taken advantage of, or cannot be used, it must immediately notify the Immigration Department of the provincial Public Security.
For the method of declaring temporary residence by Temporary Residence Declaration Form, the temporary resident declarant takes the following three steps:
Step 1: The temporary resident declarant contacts the commune-level Police Department to be provided a Temporary Residence Declaration Form according to form NA17 issued together with Circular No. 04/2015/TT-BCA dated January 5, 2015 of Ministry of Public Security.
Step 2: The temporary resident declarant writes information on this form and directly transfers it to the commune-level Police Department where the accommodation establishment is located within the prescribed time limit.
The Temporary Residence Declaration Form can be sent by fax or notified by phone to the commune-level Police Department before directly transferring.
Step 3: The temporary resident declarant shall immediately receive the Temporary Residence Declaration Form certified by the commune-level Police Department or amend and supplement it if the Temporary Residence Declaration Form does not contain sufficient information as prescribed.
